This Agreement ("Agreement") is entered into by and between Lůum at the Shore (hereinafter referred to as "Owner") and the individual identified below (hereinafter referred to as "Renter").

Whereas, Renter has agreed to rent property located at 212 75th Street Holmes Beach, FL 34217 (hereinafter referred to as "Premises") and intends to use the fire pit and/or fireplace on the Premises; and

Whereas, Renter acknowledges and understands the risks involved in using a fire pit and/or fireplace, including but not limited to, fire hazards, burns, property damage, injury, or even death to themselves, guests, or third parties;

NOW, THEREFORE, in consideration of the rental of the Premises, the mutual promises set forth herein, and other good and valuable consideration, the parties agree as follows:

1. Instructional Video Acknowledgment: Renter acknowledges that they have watched the instructional videos provided by Owner prior to using the fire pit and/or fireplace, available at luumattheshore.com/luum-guides/v/firepit and luumattheshore.com/luum-guides/v/fireplace, and agrees to operate both features only in accordance with the instructions provided therein.
2. Assumption of Risk: Renter acknowledges that the use of the fire pit and/or fireplace involves risks, including but not limited to, fire, burns, property damage, and injury, and agrees to use the fire pit and/or fireplace responsibly and with caution. Renter further acknowledges that they are responsible for their own safety, as well as the safety of any guests or members of their party who use the fire pit and/or fireplace.
3. Release and Waiver: To the fullest extent permitted by law, Renter, for themselves, their heirs, executors, administrators, and assigns, hereby releases, waives, and discharges the Owner from any and all liability, claims, demands, causes of action, or injuries arising from or related to the use of the fire pit and/or fireplace on the Premises. This includes any injury or damage to Renter, their guests, or third parties, as well as any damage to personal property.
4. Indemnification: Renter agrees to indemnify and hold harmless the Owner from any and all claims, damages, losses, liabilities, or expenses, including but not limited to attorney's fees, arising out of or in connection with Renter's use of the fire pit and/or fireplace or any actions taken by their guests or members of their party while using the fire pit and/or fireplace.
5. Fire Pit and Fireplace Use Rules: Renter agrees to abide by all fire safety rules, instructions, and regulations provided by the Owner, including but not limited to:
   • Keeping the fire contained within the designated fire pit area.
   • Never leaving either fire feature unattended.
   • Ensuring that both fire features are fully extinguished when finished.
   • Keeping flammable materials away from the fire pit and fireplace.
   • Complying with all local laws and regulations regarding fire use.
6. Severability: If any provision of this Agreement is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions will remain in full force and effect.
7. Governing Law: This Agreement shall be governed by the laws of the state of Florida and any disputes related to this Agreement shall be resolved in the courts of Manatee County, Florida.
